1. Who and where
This Limited Warranty is given by ADB Advanced Design Boats LLC ("ADB") only to the first retail buyer of a new ADB boat bought from ADB or an authorized ADB dealer in the United States, for recreational use. It covers the boat only while it is registered, kept and used within the 50 United States and their coastal waters. Any defect or damage that happens, or any repair done, outside the United States is not covered. ADB does not pay for transport of the boat to or from any place outside the United States.
2. Registration
The boat must be registered with ADB within 60 days of delivery. Without registration, the tube extension in Section 3 does not apply and tubes are covered for 2 years like the rest of the boat.
3. What is covered
Registered boats, recreational use.
- Welded aluminum hull structure: 5 yearsCracked structural welds or structural failure caused by a defect in material or workmanship
- Tubes (CSM fabric), registered boats only: 10 yearsSeam separation, delamination or porosity causing loss of more than 20% of pressure in 24 hours at normal temperature
- Entire boat, finishes, upholstery and other ADB-made parts: 2 yearsDefect in material or workmanship. Not color change or wear
Engine, battery, electronics, trailer and other non-ADB parts are covered only by their own manufacturers' warranties, which ADB passes on to the owner.
4. Commercial use
Any use that produces income, even once (rental, charter, guiding, water taxi, livery, demo, government or club use), limits all coverage to 1 year from delivery for structural defects only, not transferable.
5. What is not covered
- Collision, grounding, beaching on rock or coral, impact, puncture, cuts, abrasion, chafe from docks, chocks, davits, trailers or lifting systems.
- Over or under inflation, heat or sun exposure, fading, chalking, staining, mildew, cosmetic changes to paint, fabric or upholstery.
- Corrosion of any kind, including galvanic or stray-current corrosion, and damage from improper wiring, missing or worn anodes, or dissimilar metals added by others.
- Engines over the maximum horsepower on the capacity plate, overloading, racing, towing other boats, or improper trailering or storage.
- Lack of maintenance as shown in the Owner's Manual. The owner must keep records and show them on any claim.
- Repairs, modifications, holes or added equipment not approved in writing by ADB.
- Acts of nature, fire, theft, vandalism, freezing, sinking or swamping.
- Normal wear and tear.
- Transport, haul-out, launch, storage, travel, loss of use, rental of another boat, and any incidental or consequential damages.
6. How to claim
Notify ADB in writing within 15 days of finding the defect and before any repair, with photos, hull ID number and maintenance records. ADB must authorize any repair in writing first. The owner delivers the boat, at the owner's sole cost and risk and regardless of distance, to ADB in Texas or to a repair facility ADB names in the United States, and picks it up the same way. ADB never pays freight, trailering, haul-out, travel or lodging. ADB decides whether to repair or replace the part. Replacements may be of current equal design or color. Repair or replacement does not extend the warranty term.
7. Limits
ADB's total liability under this warranty will never be more than the price the first buyer paid for the boat. Any implied warranty, including merchantability and fitness for a particular purpose, is limited to the length of this written warranty. Some states do not allow these limits, so they may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary by state.
8. Transfer
Transferable one time, within the term, to a second owner in the United States who registers the transfer with ADB within 30 days and pays a $250 transfer fee after an ADB inspection. Not transferable for commercial-use boats.
9. Disputes
Any dispute is settled by binding individual arbitration in Bexar County, Texas, under Texas law, except small claims court actions. No class actions.
